U.S. district judge sets date for 2nd trial of Richard Burrow

   A federal judge has scheduled the second trial of former National D-Day Memorial Foundation president Richard Burrow for September, but has yet to decide where it will take place.

    Senior U.S. District Judge James Turk decided at a hearing Thursday in Roanoke to set Burrow's trial for Sept. 13 through Sept. 30. Assistant U.S. Attorney Patrick Hogeboom said at a prior hearing that he expects to call eight to 10 more witnesses than he did at Burrow's first trial in December 2002.

    The federal jury in the first trial, which lasted six days, deadlocked 7 to 5 in favor of acquitting Burrow on the four fraud charges he faced in connection with his fund raising for the Bedford memorial.

    Burrow, 57, was indicted again last month on 12 federal charges, including fraud and perjury.

    Federal prosecutors have asked that the second trial be transferred to Abingdon. John Lichtenstein, one of Burrow's lawyers, said at Thursday's hearing that they would respond to the prosecution's motion by week's end.
